COVID-19 CUSTOMER WAIVER

Due to the COVID-19 pandemic the FCDO is currently advising UK travellers against nonessential travel to a number of destinations. The FCDO advice is updated on a regular basis and it is therefore possible that by the time you depart for your holiday, the FCDO will advise against non-essential travel to your destination. We set out below the terms that will apply to you in COVID-19 related circumstances.

At the moment most countries require mandatory PCR tests and other additional health declarations to be provided. Many countries, resorts and properties are also restricting access to their facilities and the surrounding areas to help reduce the spread of the COVID-19 virus. We encourage you to regularly check the latest travel information with regards to local laws, security and entry requirements prior to travelling.

When making a booking with us today, you acknowledge and agree that:

We strongly advise that you take out insurance for your booking because without appropriate insurance you could be liable for emergency costs including medical treatment. If you already have a travel insurance policy, you should check what cover it provides for COVID-19 related events, in particular what medical cover and travel disruption the policy provides. We recommend you check the terms of your travel insurance prior to booking. If you do not yet have travel insurance and are choosing a new policy, we recommend that you check how it covers these COVID -19 related events and that you buy your travel insurance as soon as possible after booking your trip. Please also note your travel insurance may be invalidated if you travel against government advice.

It is your responsibility to check the latest FCDO advice for your destination prior to making a booking with us. We wish to remind you that at FCDO advice is frequently updated and at the moment advises against all but essential travel to a number of destinations. The latest FCDO travel advice can be found at https://www.gov.uk/foreign-travel-advice.

It is your responsibility to check the latest travel information with regards to local laws, security and entry requirements prior to making a booking and travelling, and all entry requirements and information on local measures for the destination you are travelling to. It is also your responsibility to make sure you have completed all entry requirements before you travel. Refunds

We will work with the suppliers offering the services that you have booked to try and obtain you a refund for your travel arrangements in the following situations:

Situation FCDO position at time of making your booking FCDO position at the date of your departure (including up to two weeks before date of departure)
1 Non-essential travel is ok Non-essential travel is not advised
2 Non-essential travel is ok FCDO advice is updated and requires quarantine or self-isolation measures either in the place of your destination or upon your return
3 Non-essential travel is not advised Non-essential travel is ok

Please note that we are unlikely to be able to obtain you a refund for your travel arrangements in the following situations:

Situation FCDO position at time of making your booking FCDO position at the date of your departure (including up to two weeks before date of departure)
1 Non-essential travel is not advised Non-essential travel is not advised
2 Non-essential travel is not advised Non-essential travel is ok
3 Non-essential travel is ok Non-essential travel is ok

Despite paragraphs 4 and 5 above, you should be aware that we cannot confirm that the suppliers will provide a refund and we are not required to refund you. In any instance where you are paid a full refund directly by a service provider, or you accept a free amendment or a voucher directly from a service provider (“Alternative Arrangement”), in relation to a booking made with us you agree that we will not have to pay any refund to you in respect of that booking. If the service provider makes a partial refund directly to you, then any refund payable by us to you in respect of that same booking shall be reduced accordingly. If you have already been paid a full or partial refund by us when you accept an Alternative Arrangement, you agree to immediately repay the relevant refund to us. Despite the above, when you proceed to book and travel you, and anyone else travelling on your booking, agree to not hold us, our suppliers or group companies responsible for any loss or damage suffered, including loss or damage arising from or in relation to:

  1. any restrictions put in place by the Government of the country you are travelling to;
  2. any changes to your booking resulting from additional safety, cleaning or social distancing measures; and
  3. travelling against FCDO advice.

We recommend that before making your booking you familiarise yourself with important information, regarding the risk of travelling to your intended destination and any COVID-19 related restrictions that may impact your services being booked, provided by Sitata Inc (“Sitata”). We, however, shall not be responsible for loss or damage suffered, including loss or damage arising from or in relation to your reliance on information provided by Sitata.

The above does not affect any liability we might have to you which cannot be limited or excluded by law (including under the Package Travel and Linked Travel Arrangements Regulations 2018).
