"Kids stay free" terms and conditions

1.  Introduction

1.1 The "Kids Stay Free" feature (the "Feature") is run by Thomas Cook Tourism (UK) Company Limited, with its registered address at 1 Fore Street Avenue, London EC2Y 9DT, United Kingdom, incorporated in England and Wales with registered company number 12211539 ("TCT", "we", "us", "our").

1.2 The purpose of the Feature is to facilitate the identification of accommodation that may offer favorable pricing conditions for family stays with children by displaying the Kids Stay Free Label on selected offers, subject to the specific terms set out herein. 

1.3 The Kids Stay Free Label displayed on the offer does not mean that the Child’s or Children’s holiday is free. The Feature refers solely to the accommodation element of the holidays as further described in clause 4 (Scope of the Feature). Customers are advised to read these Terms carefully to understand the full scope and limitations of the Feature before making a booking.

1.4 The Kids Stay Free feature is an ongoing feature of the Thomas Cook website and is not a time-limited promotion. It is available until further notice. TCT may add, modify, suspend or withdraw the feature (in whole or in part), including in respect of any individual accommodation or offer, at any time and without notice. Any material change to these Terms will be published on the Thomas Cook website with an updated “Last updated” date, and will not affect any booking already confirmed before that change takes effect.

1.5 These Terms and Conditions (the “Terms”) apply to the selected offers of accommodation presented at the Thomas Cook website: https://www.thomascook.com/. 

1.6 All bookings are subject to Thomas Cook's Booking terms and conditions available at https://www.thomascook.com/legal/booking-terms-conditions. All terms used but not defined in these Terms shall have the meaning ascribed to them in the Booking terms and conditions. These Terms apply in addition to, and should be read alongside, the Booking terms and conditions. In the event of any conflict between these Terms and the Booking terms and conditions, the Booking terms and conditions shall prevail.

2.  Definitions

For the purposes of these Terms:

2.1 "Adult" means a person who qualifies as an adult for the purposes of the relevant accommodation offer, as determined by the accommodation Supplier. The minimum age for an Adult may vary by accommodation and will be specified in the offer details.

2.2 "Child" means a person who qualifies as a child for the purposes of the relevant accommodation offer, as determined by the accommodation Supplier. The maximum qualifying age for a Child may be up to 17 (seventeen) years old, but this may vary by accommodation and will be specified in the offer details.

2.3 "Kids Stay Free Label" means the "Kids Stay Free" indicator displayed on selected accommodation offers on the Thomas Cook website.

3.  The "Kids Stay Free" Label

3.1 The Kids Stay Free Label is aimed at identifying accommodation offers where the total price for two (2) full-paying Adults sharing a room is identical to the total price for two (2) full-paying Adults and one (1) Child or two (2) Children, all (Adults and Child/Children) sharing the same room together, as presented in TCT's booking system.

3.2 The Kids Stay Free Label is a display indicator provided for search assistance purposes only. It reflects a pricing outcome derived from accommodation Supplier data. It does not constitute a separate promotional offer, discount by TCT, and does not create any contractual obligation or guarantee on the part of TCT in respect of the availability or terms of any such offer.

3.3 The Kids Stay Free Label is applied automatically to qualifying search results based on the details entered in the search bar, including the number of rooms, the number and ages of participants. Customers must ensure that ages are entered accurately, as eligibility is determined at the time of search.

3.4 Where a search includes more than one room, the Kids Stay Free Label is assessed separately for each room and may not apply to all rooms in a multi-room search.

3.5 Where a lower price for the same accommodation, room type and dates is available through another offer on the Thomas Cook website, that lower price will be displayed and applied instead. The Kids Stay Free Label does not prevent Customers from benefiting from any other lower price that may be available.

3.6 Where the accommodation Supplier's pricing permits only one (1) Child place to be included at no additional cost (i.e. a second Child sharing the same room would incur an additional charge), the free place will be allocated to the youngest Child, and the standard child price set by the accommodation Supplier will apply to any additional Child.

4.  Scope of the Feature

4.1 The Feature and the Kids Stay Free Label apply to the accommodation element of the holiday only: room price. They do not include, and no saving or discount of any kind is implied in relation to, any other element, including but not limited to:
•    flights or any other transport;
•    airport transfers or ground transportation;
•    travel insurance;
•    luggage, seat selection, priority boarding, or any other ancillary products;
•    meals, drinks, or extras not included in the room price;
•    resort fees, local taxes, visa fees or any charges payable locally at the hotel; or
•    excursions or other activities.

4.2 For the avoidance of doubt, even where a booking is eligible under the Feature, all charges relating to the Child or Children that do not form part of the room price remain payable in full. Deposit may be required for each participant on the booking, including Child or Children, at the time of booking, notwithstanding the Kids Stay Free Label.

4.3 Where any additional charges referred to in clause 4.1 are known and quantifiable at the time of search, they will be clearly displayed to the Customer, with the same prominence as the accommodation price, before the booking is completed, in accordance with applicable UK consumer protection law on price transparency.

5.  Availability, exceptions and changes

5.1 The Feature applies to new bookings of selected accommodation only and is subject to availability. The Kids Stay Free Label displayed in search results does not guarantee the availability of the offer at the time a booking is finalized. If no child place is available at the selected accommodation at the time of booking, the standard price charged by the accommodation Supplier will apply and will be displayed to the Customer.

5.2 The Child or Children must fall within the age range accepted by the specific accommodation Supplier for a child place. The applicable age limit is set by the accommodation Supplier and will be displayed in the offer details. Customers must verify the age limit of the Child or Children for their selected accommodation before booking. The minimum stay requirement specified by the accommodation Supplier, if any, must be satisfied.

5.3 The Kids Stay Free Label reflects the terms and conditions set by the individual accommodation Supplier, which may vary and are subject to change without notice. TCT reserves the right to remove or amend the Kids Stay Free Label in respect of any accommodation or offer at any time without notice.

6.  General

6.1 These Terms and any non-contractual obligations arising out of or in relation to them shall be governed by and construed in accordance with the laws of England and Wales. The Customers irrevocably submits to the non-exclusive jurisdiction of the courts of England and Wales for any dispute arising in connection with these Terms.

July Payday terms and conditions

Up to 20% deals savings applies to those selected hotels which are identified as being included in the promotion through message including a "Pay Day Deal" displayed on the hotel card. Prices displayed include promotional discounts already. Discounts are applied to the standard rate for selected hotels, as determined and provided by our hotel suppliers. Savings message does not apply to flight, transfer or ancillary costs.

"Free mobile data" terms and conditions

  • 8.3.1 We, in cooperation with Kolet SAS, a company registered at 6 rue d’Armaillé, 75017 Paris, France, under company number 981 094 261 (“Kolet”), voluntarily offer customers who purchase a flight ticket or a Package Holiday through our Booking System a free mobile data package (the “Kolet Data Package”).

  • 8.3.2 The Kolet Data Package includes 1 GB of mobile data and is available for each passenger included in the booking.

  • 8.3.3 The Kolet Data Package is a free promotional trial offer provided by Kolet. It is available upon the first activation of the Kolet service using a unique promotional code provided by us, or through a dedicated Kolet partner page.

  • 8.3.4 The Kolet Data Package is valid for 2 days and is available only to new Kolet customers, i.e., customers activating the Kolet service for the first time.

  • 8.3.5 To use the Kolet Data Package, you must download the Kolet mobile app (available on the App Store and Google Play), register an account within the app, and enter the unique promotional code provided to you.

  • 8.3.6 We do not transfer your personal data to Kolet. Activation and use of the Kolet service is governed by the terms and conditions set out in the Kolet Regulations, available at: https://help.kolet.com/en/articles/8703298-terms-conditions. You should read and accept these terms before using the Kolet service.

  • 8.3.7 The contract for the Kolet Data Package, and for any additional paid data packages, is between you and Kolet. We act as an intermediary only and accept no liability for any failure, deficiency or non-performance of the Kolet service. Any complaints regarding the Kolet service should be addressed directly to Kolet.

  • 8.3.8 You may purchase additional paid data packages within the Kolet app, subject to the terms and conditions set by Kolet.

  • 8.3.9 We may inform you of the free Kolet eSIM offer during telephone bookings or in connection with other Services.

"Price Match Guarantee" terms and conditions

  • At Thomas Cook we do our best to ensure that we are providing you with the best price every time, however, as we are checking millions of prices, instances may occur where you can find a cheaper price with another provider. If this does happen, we would like to be aware. If you book with us and within 24 hours of receipt of a booking confirmation find your holiday on sale, and available to book at a lower price on a UK based Online Travel Agent comparable website as described below, we would be happy to reduce the price of your holiday or refund the difference to you! This is subject to terms and conditions below.
