1. Introduction 

1.1. This promotional competition (“Competition”) is run by Thomas Cook Tourism (UK) Company Limited, incorporated in England and Wales with registered company number 12211539 (“Promoter”) and is open to all residents of the United Kingdom, the Channel Islands or the Isle of Man over the age of 18 years, except for (a) the directors, members, partners, agents, consultants or employees of the Promoter and their immediate families, (b) the directors, members, partners, agents, consultants or employees of any suppliers of any goods or services to the Promoter in respect of this Competition, or (c) the directors, members, partners, agents, consultants or employees of the Promoter’s advertising and promotion agencies and associated companies, and staff.

1.2. The rules set out in this document constitute the rules which will govern the Competition (“Competition Rules”).

1.3. Participation in the Competition by all entrants (“Participants”) constitutes and will be deemed acceptance of these Competition Rules.

2. Competition Period 

This Competition will run from 1 August 2023 to 31 October 2023 or until TCT provides a public notice that the Competition has ended, whichever is earlier (“Competition Period”). Entries will only be accepted during the Competition Period.

3. Competition Entry Process 

3.1. This Competition will take place via the following link: https://www.thomascook.com/the-x-belek-sign-up. In order to enter the Competition, a Participant must follow the entry link and provide the following details: (i) name and surname; and (ii) email address. 

3.2. Entry is only valid through this medium.

3.3 A Participant may only enter the Competition once. 

4. Description of the Prize 

4.1. The prize for this Competition is a 7-night holiday to Turkey for two adults over the age of 18 years and to be utilised within one year after the end of the Competition Period (the “Prize”).

4.2. The Prize includes the following: (i) return economy class air travel for two adults with two hold bags from any UK airport to Antalya Airport; (ii) accommodation for up to seven nights in double land view All Inclusive room at The X Belek hotel; and (iii) return transfers to The X Belek hotel. The Prize excludes expenses of a personal nature, such as: telephone; laundry; and/or transport expenses not stipulated; spending money; any airport departure or government taxes; and insurance. The Promoters will pay for the cost of 2 international travel, provided that a winner and the individual with whom a winner chooses to share the Prize (the “Guest”), shall be responsible for obtaining all travel documents (such as passports and/or visas). 

4.3.Only one Prize is available to be won during the Competition Period and the Prize has a value of up to £3,000.

4.4. If applicable, the winner must on request provide the Promoter(s) with a copy of his/her, and the Guest’s, travel documents in order for the Promoter(s) to arrange the relevant flights and accommodation.

4.5. Use of the Prize may be subject to additional terms and conditions, including as applicable to flights and other forms of transport as well as accommodation.

4.6. TCT will send the Prize to the winner electronically.

4.7. No Prize, in whole or in part, can be transferred to any other person or exchanged for an alternate prize or for its cash value. The winner may not substitute him/herself with any other person.

5. Winner Selection and Notification 

5.1. The winner will be selected by a random draw process. The draw will take place on or before 3 November 2023 and will consist of all valid entries received during the Competition Period.

5.2. The winner will be notified by TCT via email on or before 3 November 2023. If TCT is unable to contact the winner, he/she will be disqualified and a substitute winner may at the discretion of TCT be selected, using the same winner selection process.

6. Winner Verification 

6.1. The Prize will only be awarded after successful verification of the winner. Failing successful verification of the winner, a substitute winner may be selected at the discretion of TCT.

6.2. The Promoters reserve the right to carry out audits in respect of the winner to verify his/her eligibility and/or the validity of the winner’s entry. The Promoters may disqualify any winner if any fraud or cheating or related activity is suspected, including without limitation, through the manipulation of entries or otherwise falsifying data. All entries, participants, or travel partners determined by the Promoters or their agents to be invalid or ineligible will forfeit all rights to any Prize and will not be compensated in any way.

6.3. The winner and their Guest must meet the applicable travel requirements and restrictions, including those applicable to COVID-19, of all countries in which the winner and their Guest will enter when utilising the Prize.

7. Prize Forfeiture 

7.1. The winner must communicate his/her, and their Guest’s, full details to the Promoters or their agent(s) as requested by the Promoters or their agent(s). Failure to do so may result in forfeiture of the Prize.

7.2. If a winner or the Guest is unable to attend, receive or utilise (as applicable) the Prize then the entire Prize shall be forfeited. There will be no compensation, in any form, including, but not limited to monetary compensation and/or rescheduling, to any party, irrespective of the reason/s for the inability of the winner or the Guest to attend, receive or utilise (as applicable) the Prize.

7.3. Time permitting and subject to TCT’s approval, where a Prize is forfeited a substitute winner may be chosen in the same manner as the original winner was chosen.

8. General 

8.1. In the event of a dispute, TCT’s decision is final and binding and no correspondence will be entered into.

8.2. The timelines stated by TCT or its agent must be adhered to. Failing adherence to any timeline, at any stage, may result in disqualification and forfeiture of the Prize in its entirety with no compensation to any party by the Promoters.

8.3. The Promoters will not share any personal information with any third party except where such disclosure is necessary to enable the Promoters to provide, deliver or in any other way give effect to these Competition Rules and/or the Prize, where such disclosure is: (i) in accordance with the Promoters’ privacy policies available at https://www.thomascook.com/privacy-policy and (ii) as permitted by law, including where consent to the Promoters sharing personal information is obtained from the Participants. By entering the Competition, each Participant hereby consents to the Promoters’ use of their personal information, but solely for the purposes contemplated in these Competition Rules and in accordance with this paragraph 8.3.

8.4. The Promoters may make media announcements or publish the names and/or photographs of the winner and their Guest without remuneration being made payable to the winner or the Guest, provided that any such person may expressly elect to decline this by written communication to TCT.

8.5. Should the Prize not be available despite the Promoters’ reasonable endeavours to procure the Prize, the Promoters reserve the right to substitute the Prize with another of equal value as determined in TCT’s sole discretion and subject to availability. No person will be compensated in any way in this instance by the Promoters.

8.6. The Promoters will not be responsible for any costs, expenses or other liabilities incurred by the winner which are not expressly contemplated as part of the Prize.

8.7. These Competition Rules may be amended by TCT on public notice at any time during the Competition Period or thereafter. These Competition Rules will be interpreted by TCT only.

8.8. TCT reserves the right to alter, amend or cancel this Competition in whole or in part. Any alterations, amendments or cancellations will be interpreted by TCT only. In the event of an alteration, amendment and/or cancellation, the Promoters will not compensate any individual for any reason whatsoever.

8.9. Each Participant represents, warrants, and undertakes that it shall not nor shall any entry:

8.9.1. disparage the Competition, the Promoters, or any member of the Promoters’ group in any way;

8.9.2. violate a third party’s rights, including intellectual property rights; 

8.9.3. harass, bully, or unlawfully discriminate against Promoters’ personnel or third parties; 

8.9.4. make false or misleading statements; 

8.9.5. contain content which is inappropriate, indecent, hateful, or defamatory;

8.9.6. promote bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and

8.9.7. breach any applicable law. 

8.10. TCT may immediately disqualify any entry and remove any content which it determines contravenes or may contravene these Competition Rules (including paragraph 8.9 above). All Participants and the winner hereby indemnify and hold harmless the Promoters, their respective associated companies (directors, officers and employees) and agents, against any and all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever connected to or arising out of their participation in any way in this Competition or their, or their Guest’s, receipt, participation, ownership and/or use of the Prize. This indemnity is not intended to exclude any liability for any person which cannot be excluded by applicable law. 

8.11. The winner shall procure compliance by the Guest of these Competition Rules, and hereby indemnifies the Promoters, their associated companies, and the directors, officers, employees and agents of the Promoters and of their associated companies, against any and all losses, whether direct, indirect, consequential or otherwise, arising out of a claim or threatened claim by the Guest in relation to this Competition.

8.12. The Promoters shall not be responsible for any lost, damaged, corrupted, delayed, incorrect or incomplete entries for any reason whatsoever. Proof of sending an entry will not be accepted as proof of receipt of such entry. The Promoters shall not be responsible for the failure of any technical element relating to this Competition that may result in an entry not being successfully submitted. The Promoters are not responsible for lost, damaged or delayed entries as a result of any network, computer or mobile phone hardware or software failure of any kind. No applications from agents, third parties, organized groups or applications automatically generated by computer will be accepted. Entries will only be accepted if they comply with all entry instructions. Any form of network or systems manipulation including but not limited to Botnets, Sim Farms, Trojans, SMS malware may not be used when entering the Competition.  

8.13. By participating in the Competition each Participant will be asked to opt in to the Promoters’ marketing their products and campaigns to the Participant, and through the Participant’s entry into the Competition, the Promoters shall be entitled to use the entry details provided by the Participant for these purposes.

8.14. The Promoters shall not be in breach of these Competition Rules nor liable for delay in performing, or failure to perform, any of its obligations if such delay or failure result from events, circumstances or causes beyond its reasonable control.

8.15. These Competition Rules and any non-contractual rights or obligations arising out of or in relation to them, shall be governed by and construed in accordance with English law and the Participants irrevocably submit to the exclusive jurisdiction of the English courts for any dispute arising in connection with the Competition Rules or the Competition.
